• Murder accused watched Day ‘take his last breath’

    KILLED: The body of Wangaratta man Nathan Day (pictured) was found buried in a garden at a Ryan Avenue property in Wangaratta in September last year. Phillip Dunn and Darcy McNamara are charged with murdering Mr Day, and their committal hearing got underway at Wangaratta Magistrates Court this week.

    A WITNESS told Wangaratta Magistrates’ Court on Wednesday about the moment Phillip Dunn, who has been accused of the murder of Nathan Day, allegedly confessed he “watched him (Nathan) take his last breath”.

    Under cross examination, Raymond Bodsworth told the court he and Dunn were at a mutual friend’s house where they had met for the first time, when Mr Bodsworth asked the group if they were aware Mr Day had gone missing.

    He said Dunn replied “I know where Nathan (Day) went missing… I watched him take his last breath.”

    “Then he (Dunn) told me how he did it… he did it at Darcy’s (McNamara) place,” Mr Bodsworth said.

    “I didn’t believe what he was saying… he said they hit him with a hammer and choked him.

    “He said it was over drugs and money.”
